MOBILE PHONES 3-YEAR LIMITED WARRANTY (XP3, XP5s, XP8)
Subject to the conditions below, Sonim Technologies, Inc. (“Sonim”) warrants that for 3 years from the date of purchase by the original end-user, this mobile phone mobile phone (excluding any associated battery and charger, which are warranted for 1 year) will be free from defects in materials and workmanship.
What We Will Do
If during the warranty period the mobile phone has a defect in material or workmanship, Sonim, at its option, will either repair or replace it at no charge.
Sonim phones are built for heavy duty use. They are certified to resist dust and water under International Electrotechnical Commission Ingress Protection (IP) Standard 60529. This means they are designed to minimize the intrusion of dust and can be submerged in water up to 6.5 feet deep (2 meters) for up to 30 minutes. They are also shock resistant and can withstand occasional drops from up to 6.5 feet (2 meters). While our phones are tough, they are not indestructible. Use outside these parameters is not recommended and is not warranted. After immersion, always promptly rinse and dry the phone.

It is important that you keep a separate back-up copy of all, software, applications, downloads, data, settings and all other information stored on your Sonim mobile phone. Ensure you have a back-up copy before you return the mobile phone for warranty service. When the mobile phone is received for service, it will be reset to factory settings and all such information will be erased. This is done in part to protect your privacy. Sonim is not responsible for any, software, applications, downloads, data, settings or any other information lost or damaged in connection with repair or any aspect of warranty service.
Conditions and Exclusions
- This warranty only applies to Sonim branded mobile phones. It does not apply to non- Sonim products, including accessories and third-party software, even if packaged with, installed on or sold with Sonim mobile phones. Non-Sonim products may be covered by warranties provided by the manufacturer or supplier of the product.
- The battery and charger associated with this mobile phone are warranted to be free from defects in material or workmanship for 1 year from the date of purchase by the original end-user. Use only Sonim approved batteries and chargers with your mobile phone. Use of other batteries or chargers may be unsafe or damage the mobile phone.

Registering within 30 days of date of purchase will make it easier to verify that your mobile phone is eligible for warranty service. If your mobile phone is not registered, to obtain warranty service you will be required to provide a valid, original, proof of purchase issued to you by an authorized reseller, indicating the date of purchase and serial number of the mobile phone.
- Sonim warrants repaired or replaced mobile phones for the remaining duration of the original warranty or for 90 days, whichever is longer.
- Sonim may use new or refurbished parts to repair your mobile phone or may replace your mobile phone with a new or refurbished mobile phone. Replaced mobile phones and parts become Sonim’s property.
- If you return your phone for warranty service and it is found to be ineligible for warranty service, you may be charged a service fee.
- This warranty does not cover:
(a) damage resulting from abuse, accident or misuse; (b) damage resulting from use outside the parameters indicated in the User Guide, including those related to liquid, shock and dust exposure; (c) cosmetic damage including dents and scratches; (d) ordinary wear and tear; (e) damage resulting from use of this mobile phone with accessories, equipment or other mobile phones or equipment not furnished or expressly approved by Sonim; (f) damage resulting from third-party software; (g) damage resulting from maintenance, service adjustment or installation of the mobile phone, performed or attempted by any person or entity not expressly authorized by Sonim; (h) loss of use of the mobile phone (i) loss of data, information or third-party applications or software; (j) fire, flood, windstorm, lightning, earthquake, exposure to extreme weather conditions, electrical surge or improper voltage; (k) mobile phone performance issues resulting from cellular signal reception or transmission, (l) damage resulting from viruses, malware, trojan horses or other software problems; and (m) mobile phones in which the serial number is missing or has been altered, damaged or defaced.
Sonim does not warrant that use of your mobile phone will be uninterrupted or error-free.
THIS WARRANTY AND THE REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER RIGHTS, REMEDIES AND WARRANTIES. THERE ARE NO OTHER WARRANTIES, EXPRESS OR IMPLIED, WRITTEN OR ORAL. SONIM EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN LOCATIONS IN WHICH PARTICULAR IMPLIED WARRANTIES MAY NOT BE DISCLAIMED, ALL SUCH WARRANTIES ARE LIMITED TO THE DURATION OF THIS LIMITED WARRANTY. IN NO EVENT SHALL SONIM OR ITS LICENSORS BE LIABLE FOR, DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY NATURE WHATSOEVER, WHETHER RESULTING FROM BREACH OF WARRANTY OR ANY OTHER LEGAL CLAIM OR CAUSE OF ACTION, INCLUDING BUT NOT LIMITED TO i) LOSS OF, PROFITS, TIME, COMMERCIAL GAIN, DATA, PROGRAMS, SOFTWARE OR GOODWILL, ii) DOWNTIME OR DAMAGE TO OR REPLACEMENT OF PROPERTY, EQUIPMENT OR DATA. ALL SUCH LIMITATIONS ARE ASSERTED BY SONIM TO THE FULLEST EXTENT PERMITTED BY LAW.
This Limited Warranty gives you specific legal rights. You may have other legal rights depending on your state/location.
SMARTSCANNERS 2-YEAR LIMITED WARRANTY (RS60 & RS80)
Subject to the terms and conditions below, Sonim Technologies, Inc. (“Sonim”) offers you a limited warranty that the mobile device (not including any associated battery and wall charger packaged with the mobile device) will be free from defects in materials and workmanship (the “Limited Warranty”) for a period that expires two (2) years from the date of purchase by you (the “Warranty Period”), provided that you are the original purchaser of the mobile device (or alternatively, that you have the original proof of purchase), and that your purchase was made from an authorized supplier (or purchased from an end user who purchased the mobile device from an authorized supplier). This Limited Warranty is transferable to a subsequent owner or purchaser of the mobile device for the remainder of the original Warranty Period.
If, during the Warranty Period, the mobile device is found to have a defect in materials or workmanship, Sonim will, in its sole and absolute discretion, either repair (using new or refurbished parts) or replace (with a new or refurbished mobile device) the mobile device at no cost to you. Sonim will retain the original part or original mobile device that is exchanged under this Limited Warranty and the replacement part or replacement mobile device will become your property. If you return a mobile device for service under the Limited Warranty, and it is found to be ineligible, Sonim will provide you with a quote for the cost of the repair. If you elect not to repair the mobile device, you will be responsible for payment of the return shipping costs.
Warranty repair shall be performed in a good and workmanlike manner. Sonim warrants the repaired or replaced mobile device for the remaining duration of the Warranty Period, or for ninety (90) days, whichever is longer. Your sole and exclusive remedy with regards to warranty repair shall be to request Sonim to re-perform the non-conforming warranty repair.
This warranty only applies to Sonim-branded mobile devices. It does not apply to non-Sonim products, including accessories and third-party software, even if packaged with, installed on or sold with Sonim mobile devices. Non-Sonim products may be covered by warranties provided by the manufacturer or supplier of the product. The battery and wall charger packaged with the mobile device are warranted to be free from defects in material or workmanship for one (1) year from the date of purchase by you.
Sonim encourages you to register your mobile device on Sonim’s website: http://www.sonimxperience.com/registration_portal/portal/registration.php. Registering within thirty (30) days of the purchase date will make it easier to verify that your mobile device is eligible for warranty service. In order to obtain warranty service for an unregistered mobile device, you will be required to provide a valid, original, proof of purchase issued by an authorized reseller, indicating the date of purchase and serial number of the mobile device.
You are responsible for keeping a separate back-up copy of all software, applications, downloads, data, settings and other information (“Your Information”) on the mobile device, as some or all of Your Information may be deleted or reformatted during the course of Sonim performing the warranty service. Sonim is not responsible for Your Information that is lost or otherwise damaged in connection with of the provision of any warranty service.
This Limited Warranty is conditioned upon the proper use of our mobile device and does not cover: (a) damage resulting from abuse, accident or misuse; (b) damage resulting from use outside the parameters indicated in the user guide, including those related to liquid, shock and dust exposure; (c) cosmetic damage including dents and scratches; (d) ordinary wear and tear; (e) damage resulting from use of this mobile device with accessories, equipment or other mobile devices or equipment not furnished or expressly approved by Sonim; (f) damage resulting from third-party software; (g) damage or missing components of the mobile device, or damage of the sensor modules resulting from maintenance, service adjustment, removal or installation of the mobile device performed or attempted by any person or entity not expressly authorized by Sonim; (h) theft or physical loss of the mobile device; (i) loss of Your Information or third-party applications or software; (j) damage caused by fire, flood, windstorm, lightning, earthquake, exposure to extreme weather conditions, electrical surge or improper voltage; (k) mobile device performance issues resulting from cellular signal reception or transmission; (l) damage resulting from viruses, malware, trojan horses or other software problems; and (m) a mobile device in which the serial number is missing or has been altered, damaged or defaced.
USE ONLY APPROVED ACCESSORIES (INCLUDING BATTERIES AND CHARGERS) WITH SONIM MOBILE DEVICES. USE OF ANY UNAUTHORIZED ACCESSORIES MAY BE DANGEROUS AND WILL INVALIDATE THIS LIMITED WARRANTY.
SONIM SHALL NOT UNDER ANY CIRCUMSTANCES WHATSOEVER BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR DIRECT, INDIRECT, SPECIAL, GENERAL, PUNITIVE, EXEMPLARY, AGGRAVATED, INCIDENTAL OR CONSEQUENTIAL DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY THEREOF, WHETHER FORESEEABLE OR UNFORESEEABLE OF ANY KIND WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, UNANTICIPATED BENEFITS OR REVENUE, ANTICIPATED PROFITS ARISING OUT OF USE OF OR INABILITY TO USE THE MOBILE DEVICE (FOR EXAMPLE, WASTED AIRTIME CHARGES DUE TO THE MALFUNCTION OF A MOBILE DEVICE) OR CONTRIBUTION OR INDEMNITY IN RESPECT OF ANY CLAIM RELATED TO A MOBILE DEVICE.
REPAIR OR REPLACEMENT OF A DEFECTIVE MOBILE DEVICE, AS PROVIDED UNDER THIS LIMITED WARRANTY, ARE YOUR SOLE AND EXCLUSIVE REMEDIES FOR BREACH OF THE LIMITED WARRANTY, AND SUBJECT TO THIS LIMITED WARRANTY, THE MOBILE DEVICES ARE APPROVED AND ACCEPTED BY YOU “AS IS”.
SONIM MAKES NO OTHER WARRANTIES, REPRESENTATIONS OR CONDITIONS OF ANY KIND, ORAL OR VERBAL, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, WITH RESPECT TO THE MOBILE DEVICE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OR CONDITION OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR FOR INFRINGEMENT OR ANY IMPLIED WARRANTY OR CONDITION ARISING OUT OF TRADE USAGE OR OUT OF A COURSE OF DEALING OR COURSE OF PERFORMANCE. NO DEALER, DISTRIBUTOR, AGENT OR EMPLOYEE IS AUTHORIZED TO MAKE ANY MODIFICATION OR ADDITION TO THIS LIMITED WARRANTY.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages or allow limitations on how long an implied warranty lasts, so the above limitations or exclusions may not apply to you. This Limited Warranty gives you specific legal rights, and you may also have other rights which vary from jurisdiction to jurisdiction. If any portion of this Limited Warranty is held to be illegal or unenforceable, such illegality or un-enforceability shall not affect any other provisions of the Limited Warranty.
All disputes arising between Sonim and you (the “Parties”), either out of or in connection with this Limited Warranty will be resolved through final and binding arbitration, and not by trial. Such dispute shall be resolved and settled in accordance with the then prevailing Comprehensive Arbitration Rules of JAMS by one (1) arbitrator appointed in accordance with such rules. The award shall be final and binding. The Parties agree to recognize the decision of the arbitrators as final, binding and executable. The arbitration shall be the exclusive remedy of the Parties to the dispute regarding claims or counterclaims presented to the arbitrator.
